How to Serve a Divorce Petition When the Court Bailiff Cannot
If the respondent has failed to acknowledge the Petition, you will usually be required to serve this yourself. The options are you can instruct a County Court Bailiff to try and serve the Petition for you, or you can employ a Process Server to do it for you. A Process Server is a person who delivers ("Serves") court proceedings for a living and will often charge less than the County Court Bailiff.
You must ensure the Petition is served correctly in order to proceed further with your divorce. You will need to file evidence with court to show how the respondent was served. A Petition cannot usually just be posted through the letterbox. The Petition must be handed to or left with the Respondent. You can ensure it is served correctly by employing a Process Server to do this for you.
Whilst a Process Server cannot guarantee your divorce petition will be served personally, they should still be able to help you even if they have had problems serving the Petition. If service has been unsuccessful, then a Statement of Attempted Service can be completed. The statement of attempted service can be used as additional evidence to prove to the Court the Respondent is evasive. It will detail what reasonable attempts have been made to serve the Petition. You may then be able to ask the Court to Dispense with Service or apply for Deemed Service. You may also be able to apply for an Order that allows your Petition to be served by an alternative method, such as placing through the letterbox.

You might be surprised to learn that we usually charge less to serve a Divorce Petition than what the County Court would charge you! We provide low cost, fixed fee service and we will make multiple visits (usually up to three) to the one address.
Once the Divorce Petition is served, we will provide you with a Statement of Service which you then lodge with the Court. This confirms the date and time the Petition was served. If we cannot personally serve the Petition then we will provide a statement of attempted service. You can use this to demonstrate to the court the reasonable efforts made to serve the Petition and hopefully move to the next stage of your divorce.

To instruct a Process Server we are normally sent the Application for Divorce, the acknowledgement of service and the notice of proceedings. More recently, we are sent the Application for divorce and the invitation to file and acknowledgement of service. If you do not have copies of these documents you will need to ask the court for them. You will need to tell the court you are instructing a Process Server and may be required to provide our details.
Sending a photograph or Description of the Respondent is also useful to help identify the person to be served along with any helpful information such as their working hours or when they most likely can be found at their property.

You should get someone else to serve them for you, someone who is not a party to the proceedings, otherwise the court may not be satisfied the respondent has been served correctly. To begin with, the court will serve a copy of the paperwork. If the Respondent doesn’t acknowledge they have received the papers, then you will need to organise service of the papers yourself, usually through the court bailiff or a Process Server.
The answer is not straightforward. You would need to demonstrate to the court what attempts have been made to serve the Petition. You can ask a Process Server or Enquiry Agent to try and trace the Respondent. If this fails, you may be able to ask the court to dispense with service. We suggest speaking to your legal advisor about this.

You should use someone who has no interest in the proceedings, or its outcome. You can do this by hiring a Process Server to serve your Divorce Petition for you.
