How to serve a Statutory Demand?
If you need help serving a statutory demand, we can assist you. You must do everything possible to bring the statutory demand to the debtor's attention. In most circumstances, the statutory demand must be handed to or left with the person or company that owes you the money. It cannot normally just be posted to the debtor. One of the quickest ways you can get a Statutory Demand served correctly is to instruct a Process Server to serve the demand for you. A Process Server is a person who delivers ("Serves") court orders and legal documents for a living.
The statutory demand, when used correctly, is an effective form of debt recovery. When the individual or company that owes you money (the ‘debtor’) receives (is 'served') a statutory demand, they have a limited amount of time to deal with it. Once served, they could: -
If they fail to pay or reach an agreement to pay with you, then you could apply to bankrupt the debtor or wind-up and close the company. The prospect of bankruptcy or liquidation is often enough to provoke payment.
The Statutory Demand when used correctly, on undisputed debts above £750.00 for companies and £5000 for individuals and debts which are less than 6 years old, is an excellent form of Debt Recovery. There is no need for Court action and the Demand can be served very quickly.

You would then use a Process Server to Serve the Statutory Demand. We serve Statutory Demands throughout England and Wales for a fixed fee. Once served, we will provide you with a Certificate of Service to confirm the date and time the Statutory Demand has been served on the debtor.

Getting a Statutory Demand served by a Process Server can be a quick and easy task. You can issue a statutory demand to ask for payment of a debt from an individual or company. Follow these three simple steps to begin.
If you are owed money, you can issue a statutory demand. As you have read, serving a Statutory Demand is normally very easy to organise. There is no need for court action and you don't need a lawyer to assist you. However, you should seek legal advice if you are unsure whether the statutory demand is the correct route for you. Other options may be available.
If the debt is over 6 years old, you cannot usually issue a Statutory Demand. We suggest you seek legal advice instead.

As of 31 March 2022, The Schedule 10 notice is no longer required to be served. This would have been previously been served, pursuant to the Corporate Insolvency & Governance Act 2020 (Coronavirus). This Act ended on 31 March 2022, so the requirement is no longer needed.
We can help you issue and serve a Statutory Demand on a company. You will need to complete the SD1 statutory demand and then send this to us for service. The amount should be for £750.00 or more, and undisputed.
Once we receive your instructions, our Process Server will attend the company address to serve the demand for you. A Statutory Demand is normally served on a limited company at their Registered Office address. This could be a firm of accountants who act as the Registered Office address for the company but it could also be their trading address. A demand would be served at the registered office address by handing it to a Director, Employee or Officer of the company. If no one is present at the registered office address then it will normally be served by leaving it at the registered address in such a way as it is likely to come to the attention of anyone attending the registered office address.
If we are serving a partnership, then we can serve the partnership at their principal office. It could be served by leaving it with a member of staff at their office address, or by handing it to a partner at any address they can be found. You cannot serve a member of staff away from the office address.
If you are serving a sole trader, then like serving a private individual, you must do everything you can to bring this to their attention. Attempts at service should be made at all known addresses and where possible it should be served personally by handing it to, or leaving it with the person who owes you the money.
Once served, a certificate of service is prepared and sent to you to confirm the date and time service.

How to serve a Statutory Demand on a Company?

Which demand you use, depends on the circumstances of the debt such as it s payable now, or based on a Judgment amount. The amount owed should be for £5000.00 or more and the debt should be undisputed.
If you are serving a private individual then you must do everything you can to bring the demand to their attention. Attempts at service should be made at all known addresses and where possible it should be served personally by handing it to, or leaving it with the person who owes you the money.
If the person cannot be served by personal service you may be able to serve the demand on them by substituted service such as leaving it at their address or by any other means permitted by the court. To ensure service complies with the insolvency rules, there is a procedure to follow if serving a statutory demand by substituted service.
Once served, a certificate of service is prepared and sent to you to confirm the date and time of service.
